Family Code: Royal Referral Protects against Individual Interpretations (Local Council of Ulema Member)

The Royal referral to the Higher Council of Ulemasof certain proposals of a religious nature, brought to the High Appreciation of His Majesty King Mohammed VI by the Body in charge of revising the Family Code, makes it possible to guard against individual interpretations in this area, said Abdelkamel Boulaamane, member of the Rabat Local Council of Ulema.

In a statement to MAP, Boulaamane said that collective reflection on these proposals within the Higher Council of Ulema will lead to a consensus to help protect the Ummah against any deviation, stressing, in this connection, the importance of framing Fatwas in order to avoid discord and preserve the general interest.

In practicing Ijtihad to interpret religious texts, Ulema take into account the rules of Fatwa in more ways than one, particularly with regard to the spirit of Sharia, which aims to safeguard interests and prevent perversity, and the mechanisms of Islamic jurisprudence.

Boulaamane added that Islamic Fiqh is not set in stone, stressing that the Ulema of the Higher Council will rely on the virtues of moderation and open, constructive Ijtihad, in accordance with the Royal High Directions.

His Majesty King Mohammed VI, may God assist Him, President of the Higher Council of Ulema, has given His High Directives to the said Council, to examine certain questions contained in the proposals of the Body in charge of revising the Family Code, with reference to the principles and precepts of the holy religion of Islam and its purposes, and to submit a Fatwa on their subject to the Sovereign’s High Appreciation.
