Lack of Detailed Convict Reports Shouldn’t Get in the Way of Considering Alternative Sentences – Justice Minister

Morocco’s Justice Minister Abdellatif Ouahbi urged against resorting to imprisonment as a default due to the absence of detailed convict reports. Instead, he advocates for greater flexibility in considering alternative sentences.

Speaking at a meeting hosted by the Supreme Council of the Judicial Power on Wednesday in Rabat, Ouahbi emphasized that judges hold full discretion in applying this law, known as Law No. 43.22. This means they determine not only the nature and scope of the sentence, but also how it’s carried out.

In his view, alternative sentences are a step in the right direction, offering a viable alternative to prison. He pointed out that countries around the world have successfully implemented these alternatives, sharing international examples of practical measures that work.

Alternative sentences can take various forms, including community service, electronic monitoring, restrictions on certain rights, or preventive, rehabilitative, and curative measures. The law also covers provisions related to day-fines.

Law 43.22 aims to keep pace with global changes in public rights and freedoms, helping offenders gain skills and reintegrate into society. It also tackles the growing problem of overcrowded prisons and offers a more cost-effective approach.

However, it doesn’t apply to crimes that carry more than five years of prison time or to repeat offenders who haven’t responded to previous deterrents.
